1. Acceptance of Terms

By accessing or using ToggleTest's feature flag and experimentation platform, website, APIs, and SDKs (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ToggleTest provides a feature flag management and experimentation platform that enables you to control feature rollouts, run A/B tests, target users, and manage progressive delivery through our dashboard, APIs, and SDKs.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Plans and Billing

  • Free Plan: Includes 10,000 evaluations per month with unlimited flags, A/B tests, and team seats at no cost
  • Paid Plans: Billed monthly. Pricing is based on evaluation volume as described on our pricing page
  • Upgrades and Downgrades: You may change your plan at any time. Changes take effect at the start of the next billing cycle
  • Overages: If you exceed your plan's evaluation limit, additional evaluations may be throttled or billed at overage rates

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code
  • Resell or redistribute the Service without our prior written consent

6. Your Data

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Service. We will not access Your Data except as necessary to operate the Service, provide support, or as required by law.

7. SDK and API Usage

Our SDKs are provided under open-source licenses as specified in their respective repositories. API access is subject to rate limits based on your plan. You are responsible for securing your SDK keys and API tokens and must not expose server-side keys in client-side code.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Our SDKs are designed with local evaluation and caching to minimize the impact of any service disruptions. Scheduled maintenance will be communicated in advance when possible.

9. Intellectual Property

The Service, including its design, features, and documentation, is owned by ToggleTest and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding. You may reference ToggleTest in your documentation to describe your integration.

10. Limitation of Liability

To the maximum extent permitted by law, ToggleTest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless ToggleTest and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
